Economic, social and cultural Human Rights (JUS360)

 

Autumn 2007

You may choose one of the following topics:

  1. Consider the indivisibility and interdependence of human rights in light of the conditions prevailing for people living in poverty.  Discuss the extent to which the content of the right to development may have positive impact on the respect and protection of human rights of people living in poverty.

  2. Describe the nature of state obligations for economic, social and cultural rights as set out under Article 2 of the Covenant on Economic, Social and Cultural Rights. Please describe how the Committee on Economic, Social and Cultural Rights has interpreted these obligations in general in the Commitee's General Comment number 3, and more specifically with regard to the right to food (Article 11) in General Comment number 12 or with regard to the highest attainable standard of health (Article 12) in General Comment 14.

  3. Consider how international human rights law may be regarded as universally valid and relevant despite social and legal differences between nations and cultures. Discuss the positions of respectively universalism and cultural relativism, and consider at which level (concept, interpretation, implementation) disagreements concerning particular human rights will normally occur.
